THIS IS A NOTICE OF INTENT TO AWARD A SOLE SOURCE CONTRACT FOR COMMERCIAL LEGAL SERVICES (№6014206)

This is a notice issued as required by FAR 5.203. Because this procurement will be for commercial services and have a not-to-exceed value of below the $7000000, OPIC intends to award this sole source contract under the authority of FAR 13.501(a)(1).

OPIC requires legal counsel to represent and advise OPIC in connection with the negotiation and documentation of the OPIC Loan to Abraaj Growth Markets Health Fund (the "Borrower"). It is essential for OPIC to engage a law firm that has existing knowledge of and experience with this transaction in order to minimize risk of serious financial injury to OPIC in its recovery prospects.

In order to perform this work, a law firm must have attorneys directly employed by the firm who have provided representation or counsel in connection with the Abraaj Growth Markets Health Fund and who are experienced in enforcing legal rights in transactions where circumstances give rise to adverse matters between the lender and the borrower. The attorneys must also not be limited or prevented by conflict of interest from representing OPIC in this matter.

The North American Industry Classification System (NAICS) code for this requirement is 541110 with the size standard of $11 million. This notice of intent is not a request for proposals or quotes; however, all responsible and capable sources may submit statements of capabilities, which, if received within seven calendar days of publication of this notice, shall be considered by OPIC. A determination by the Government not to open the requirement to competition based upon the responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement.
