Reasons for the decision to award: After assessment of all evaluation criteria mentioned in tender document (qualitative criteria and price) the winning tenderer has received the most utility points among all the submitted bids. The offer of the winning tenderer convinced above all regarding: - AC 1:The recruitment and training of the deployed security personnel has been well documented. All staff deployed guards provide a license and bring adequate training- and English skills. - AC 2: The management has proven extensive experience in providing security to international missions / organizations, has a systematic oversight of the staff deployed, and can provide an adequate control room / RRT in close proximity to our presentation and expatriate residences.
Procedures for appeal:In accordance with Art. 56 PPA para. 1 of the Federal Act on Public Procurement (PPA) an appeal may be lodged in writing with the Federal Administrative Court, P.O. Box, 9023 St Gallen within 20 days of the decision being notified. The appeal must be submitted in duplicate and must contain the requests, the reasons for them with a statement of the evidence and the signature of the person filing the appeal or his or her representative. A copy of the present decision and any available evidence must be enclosed. The provisions of the Administrative Procedure Act (APA) on legal holidays do not apply in accordance with Article 56 paragraph 2 of the PPA. Based on Article 52 paragraph 2 of the PPA, the appeal can be used only to establish that this decision violates federal law, but not to apply for its cancellation. Foreign providers are permitted to appeal only to the extent that the state in which they are domiciled grants reciprocal rights.
The information in the invitation to tender publication regarding the point 1.9 “scope of international treaties” was indicated as “yes” instead of “no”. As indicated in the tender documents, this tender falls outside the scope of international treaties. Therefore, the present award publication was corrected form “scope of international treaties: yes” to “scope of international treaties: no”. The procedures for appeal have been completed accordingly under point 4.5.
